Operator

The Sowa Answers service (this website, AI receptionist, missed-call capture, SMS follow-up, dashboard, and related features) is operated by Lesniak Advisory, a sole proprietorship registered in the Province of Ontario, Canada (Ontario Business Identification Number 1001490274), with its registered business address at 208 Tremont Road, London, Ontario, N5V1C4. In these Terms, "we," "us," and "our" refer to Lesniak Advisory in its capacity as operator of Sowa Answers, and references to "Sowa Answers" identify the product offered to customers under that brand. Customers contract with Lesniak Advisory.

Acceptance

By using the Sowa website and Sowa Answers services (including missed-call capture, AI receptionist, and related features), you agree to these Terms of Service with Lesniak Advisory, the operator of Sowa Answers (the "Operator"). If you do not agree, do not use our services.

Use of Service

You must use our services only for lawful purposes and in line with these terms. You are responsible for your account, your content, and how you use the service. You may not misuse the service, attempt to gain unauthorized access, or use it in a way that harms others or our systems. Prohibited use includes, but is not limited to: illegal activity, harassment, spam, fraud, or any use we reasonably consider inappropriate or unsafe. We may suspend or terminate your account for breach of these terms.

Account

You must provide accurate information when signing up. You are responsible for keeping your password secure and for all activity under your account. Notify us promptly of any unauthorized use.

Payment and Subscription

Subscription fees are billed in advance in CAD. The price stated at signup applies for your current billing period. We may change prices or plans for future periods with notice; continued use after changes constitutes acceptance. By subscribing, you authorize us to charge your payment method. All fees are final for the period billed unless required by law. Free trials, if offered, are subject to the terms stated at signup.

Free Trial

Sowa Answers offers a 7-day free trial when you sign up with a valid payment method. During the trial you have full access to your selected plan and your card is not charged. At the end of the trial, your subscription begins automatically and your card is charged the plan price plus applicable taxes. You may cancel at any time before the trial ends from your dashboard (Billing) to avoid being charged. Free trials are limited to one per customer and are not transferable.

Cancellation

You may cancel your subscription at any time from your dashboard (Billing) or by contacting us. When you cancel, we ask for the reason to help us improve. Cancellation takes effect at the end of your current billing period. No refunds for partial periods unless required by law.

Suspension and Termination

We may suspend or terminate your account at any time if we reasonably believe your use is inappropriate, abusive, illegal, harmful to others or our systems, or in breach of these terms. We may also suspend or terminate for operational or safety reasons. If we terminate your account for cause, you are not entitled to a refund for the current or any prior period. We will give notice where reasonably practicable unless immediate action is required.

Intellectual Property

Lesniak Advisory owns the Sowa Answers platform, branding, and all related intellectual property. We grant you a limited license to use the service as intended. You do not acquire any ownership rights in our IP.

AI Responses, Estimates, and Quotes

The Sowa Answers receptionist is an AI assistant. It talks with callers, captures their request, and may share information you have configured in your dashboard (services, hours, location, general pricing). Any price, time estimate, availability, or scope of work that the AI mentions on a call or in a message is an informational estimate only and is not a binding quote, contract, or guarantee. Binding offers are made only by you (the business owner) after you review the call, the transcript, and the caller's specific situation.

You are responsible for the accuracy of the information you provide to the AI (services, pricing, hours, policies, training URLs) and for reviewing the AI's transcripts, summaries, tags, and urgency classifications before acting on them. The AI may misunderstand callers, mis-transcribe speech, or produce summaries that do not capture every relevant detail. You agree to confirm critical details directly with the caller before committing to work, dispatching a technician, honoring a price, scheduling at a specific time, or making any safety-related decision.

We are not liable for losses that result from relying on an AI-generated estimate, summary, or classification without independent verification.

Your Callers and Third-Party Content

You are responsible for how you publish and route the phone number that connects to Sowa, and for any legal requirements in your jurisdiction relating to call transcription, AI disclosure, consent, and SMS marketing. Sowa Answers currently transcribes calls and does not retain call audio. The AI receptionist announces at the start of each call that the caller is speaking with an AI and that the call is being transcribed, which is sufficient for "single-party" consent jurisdictions; if your jurisdiction requires all-party or affirmative consent, you are responsible for ensuring that requirement is met (for example, by posting notice on your website or on business signage, or by re-announcing as needed).

Content submitted by your callers (names, phone numbers, messages, call transcripts, any details they volunteer) is stored in your Sowa dashboard so you can follow up. Call audio is processed transiently to produce the transcript and is not retained. You are the controller of that information in your business context and are responsible for using it lawfully.

Phone Number Porting

You may bring an existing business phone number to Sowa Answers ("port-in"), or move a Sowa-assigned number to another provider when you cancel ("port-out"). Porting is governed by the rules of the Canadian Radio-television and Telecommunications Commission (CRTC) and the Canadian Numbering Administrator (CNA). Where your number is, where it can be moved, and how long the move takes are all subject to those rules and to the cooperation of your existing or destination carrier.

Authorization.By submitting a port-in request, you authorize Lesniak Advisory and its underlying carrier (Telnyx LLC) to act on your behalf with your current carrier (the "losing carrier") to transfer the number to Sowa Answers. This authorization remains valid for sixty (60) days from execution of the Letter of Authorization (LOA) per CRTC rules.

Your responsibilities.You must (a) provide ownership and billing information that exactly matches what your losing carrier has on file (mismatches are the most common reason for port rejection); (b) supply a valid LOA signed by the authorized account holder on the losing carrier's account; (c) not cancel service with your losing carrier until we confirm the port has completed; and (d) keep your account with the losing carrier in good standing throughout the port window. Cancelling early can release your number back to the losing carrier's pool, where it may become permanently lost.

Carrier execution and timelines. The port itself is performed by Telnyx as the gaining carrier. Standard ports typically take seven to fourteen business days but can extend depending on the cooperation of the losing carrier. We cannot guarantee a specific Firm Order Commitment (FOC) date. Ports may be rejected by the losing carrier for reasons including, but not limited to: address mismatch, missing port PIN, account in arrears, account locked, or numbers not portable to the destination region. Resolving rejection causes is your responsibility, working with your losing carrier directly.

What happens to your Sowa-assigned number after a port-in. When you port your existing number to Sowa Answers, the Sowa-assigned number originally provided to you is released back to our number pool. Your ported number becomes your only Sowa line. You will not be charged for the released number, and we may reassign it to a future customer after a cooling-off window.

Port-out. You may port your Sowa Answers number to another provider at any time. Per CRTC Local Number Portability rules, we are required to facilitate port-out within standard service intervals and we will. Initiate the port through your new provider; we will cooperate with their port-in request. The cancellation flow in your dashboard offers three options when you leave: port your number to a new carrier, hold the number for ninety (90) days for possible reactivation, or release it immediately back to our pool.

Liability and disclaimers.We are not liable for delays, errors, or rejections caused by your losing carrier or by Telnyx. We are not liable for service interruption during the port window, for loss of business or revenue arising from port delays or failures, or for the integrity of data on the losing carrier's network. Our total liability relating to porting is subject to the cap stated in Limitation of Liability below.

Canadian customers. If you believe we have not met our porting obligations, you may file a complaint with the Commission for Complaints for Telecom-television Services (CCTS) at 1-888-221-1687 or ccts-cprst.ca.

Disclaimer

The service is provided "as is" and "as available." We do not warrant that it will be uninterrupted or error-free. We are not liable for outcomes that depend on how you or your callers use the service. AI and automated responses are not guaranteed to be accurate or appropriate in every situation; you are responsible for how you use the service and for reviewing call and message content.

Limitation of Liability

To the maximum extent permitted by law, Lesniak Advisory and its affiliates are not liable for any indirect, incidental, special, or consequential damages, or for loss of data, revenue, or business opportunities arising from your use of the service. Our total liability is limited to the amount you paid us in the twelve months before the claim.

Changes to These Terms

We may update these terms from time to time. We will post the updated terms on this page and update the "Last updated" date. Material changes may be communicated by email or a notice on the site. Continued use of the service after changes constitutes acceptance of the updated terms.

Governing Law

These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes are subject to the exclusive jurisdiction of the courts of Ontario.
